Service Terms & Conditions

1. By confirming your order, you acknowledge that you have read the offer details and agree to the following terms and conditions of sale.

2. Stay by Kim reserves the right to amend these general terms and conditions of sale at any time. The amended terms shall become effective as of their date of publication or posting. For services contracted prior to the date of amendment, the terms and conditions in force on the date of purchase shall remain applicable until the expiration or renewal of the relevant service.

In the event of a subscription renewal or service extension, the general terms and conditions of sale in effect on the date of renewal shall automatically apply to the new period.

3. Airbnb users, whether hosts or guests, must be at least 18 years old, in accordance with Airbnb's Terms of Service.

4. Payment: Payment is made in US dollars (USD) via the secure Stripe platform.

5. Service timeline: The service begins upon receipt of payment.

6. Communication: All exchanges will take place by email or through a previously agreed messaging platform.

7. Commitment: Stay by Kim commits to providing a professional, personalized, and confidential service, within the announced timelines.

8. Client responsibility: The client is responsible for providing all necessary information for the proper execution of the mission.

9. The host authorizes Stay by Kim to share visual excerpts of their property for professional communication purposes (website, social media), without disclosing any personal information.

10. Confidentiality: All exchanged information will remain strictly confidential.

11. Cleaning service management : The owner selects and appoints their preferred cleaning provider and provides Stay by Kim with the full contact details of the chosen cleaning team. Stay by Kim manages the scheduling coordination, and quality follow-up of cleaning operations, but does not conduct the search, selection, or recruitment of cleaning providers. The cost of cleaning services remains the responsability of the owner and is invoiced directly to them by the approved provider. Any special request or additional cleaning service will be quoted in advance and require prior approval from the owner.

12. Refunds: No refunds will be made once the service has started.

13. Client cancellation: If the client cancels before the service begins, a partial refund may be considered at the discretion of Stay by Kim, depending on the circumstances.

14. Monthly Subscriptions: The $400 and $700/month services are subscriptions that renew automatically every month. The client can cancel the subscription at any time before the next billing cycle via their Stripe link or by contacting Stay by Kim. No refunds will be made for a month already in progress.

15. Right to refuse: Stay by Kim reserves the right to refuse or interrupt any service or subscription, including those already in progress, in the event of non-compliance with the general terms, disrespectful or inappropriate behaviour, or a serious disagreement that undermines the relationship of trust. No refund will be issued in such cases.

Force Majeure Clause

Stay by Kim shall not be held liable for the total or partial non-performance of it's obligations if such non-performance results from a force majeure event as defined by law, including but not limited to : natural disasters, epidemics, pandemics, fires, floods, strikes, wars, acts of terrorism, network outages, cyberattacks or acts of cybercrime, governmental decisions, or any other circumstance beyond its control. In the event of force majeure, Stay by Kim will inform the client as soon as possible. The performance of obligations shall be suspended for the duration of the force majeure event.

Disclaimer of Liability

Stay by Kim operates strictly within the scope of services defined in the selected offer. The agency cannot be held liable for any dispute between the host and their guests, nor for damages, cancellations, or any other incident occurring on-site. All services are provided remotely and virtually. The client remains solely responsible for the physical management of the property.

Limitation of Liability Regarding Reviews and Ratings

Stay by Kim shall not be held liable for any rating, negative review, or complaint submitted on the Airbnb platform, provided that the service rendered complies with these general terms and conditions and the instructions of the host. Any loss of income, damage to image, deterioration of reputation, or costs resulting from a rating, review, or Airbnb decision shall remain the sole responsibility of the host/owner.

Clause on Airbnb Decisions

In the event of a complaint or dispute handled by Airbnb resulting in a refund, compensation, or payment to a guest, Stay by Kim cannot be held responsible, except in the case of proven and substantiated fault in the performance of the service, duly evidenced by the host.

Exclusion Clause for Matters Beyond Stay by Kim’s Management

Stay by Kim shall not be held responsible for any inconvenience, dissatisfaction, or dispute arising from matters outside the scope of the entrusted management (cleaning, maintenance, property condition, neighborhood disturbances, etc.) or for any situation beyond its control.

Limitation of Financial Liability Clause

Under all circumstances, the financial liability of Stay by Kim under these general terms and conditions shall be expressly limited to the total amount of fees received for the relevant service.

Applicable Law and Jurisdiction

These general terms and conditions of sale are governed by the law of the United States. In the event of a dispute that cannot be resolved amicably, any legal proceedings shall fall under the exclusive jurisdiction of the courts of the United States.
